What the inspector wrote

On 6/10/2025, at 2:55pm, Licensing Program Analyst (LPA), Vicky Williamson conducted an unannounced Annual Random inspection and inspected the facility for an increase in capacity. LPA met with Licensee, Danelie Saint Phat Cham and discussed the purpose of the inspection. Also present is Licensee's Spouse, Frantz Saint Phat and four minor children. There were no daycare children present. Days and hours of operation are Monday through Saturday, 7:00am to 7:00pm. A fire clearance for a large family child care home was granted on 5/30/2025. This five (5) bedroom, three (3) bath home was toured and inspected. The following areas are used for daycare: living room, kitchen and bedroom 2 (kids play area), bathroom 3 and the fenced backyard. Off limit areas include bedroom 1 (master bedroom), bedroom 3, bedroom 4, bedroom 5, bathroom 1 (inside of master), bathroom 2 (hallway), and the garage. Off limit areas with the exception of bathroom 2 are made inaccessible to daycare children by doorknob safety locks. Licensee stated that the fenced backyard is used for outdoor activities. Licensee was reminded that children should always be supervised during outdoor activities. LPA advised the Licensee that prior to making alterations or additions to the home or grounds, the Licensee shall notify the Department of the proposed change. Licensee updated the facility sketch during time of inspection. The fire extinguisher, smoke and carbon monoxide detectors meet requirements and are operational. All poisons, detergents, cleaning compounds, medications and other hazardous items in the home are made inaccessible to children through latches, locks, and/or placed on high surfaces. Licensee has children's toys, play equipment and books available. Licensee has a working cell phone. LIC 809C Continuation\342\200\246 Licensee stated there are no bodies of water on the premises. Licensee stated that there are no firearms, ammunition or other weapons on the premises. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Pediatric CPR/First Aid certification for licensee is valid through 9/20/2025. Licensee has required immunization records on file. Mandated Reporter training certification for licensee is valid through 7/17/2025. LPA informed licensee to ensure that Pediatric CPR/First Aid certification and mandated reporter training is completed once every two years. LPA observed the required documents posted. A sample of children\342\200\231s files were reviewed and were determined to be complete. The last fire drill was conducted and documented on 4/18/2025. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual \342\200\223 Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA and licensee discussed and reviewed the following: Report suspected child abuse and neglect, form LIC 311D, maintaining children\342\200\231s records according to regulation, posting required forms. Licensee is reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. Licensee was also provided information regarding SIDS, Lead Exposure and Shaken Baby Syndrome. Applicant provided proof of control of property to the Department. Applicant states that she is financially secure to operate a family childcare home for children and will comply with all regulations and laws governing family childcare homes. LPA and licensee discussed the maximum number of children for whom care shall be provided when there is an assistant in the home, including children under age 10 who live in the licensee's home shall be either: Twelve (12) children with no more than four of whom may be infants and 8 older children over the age of 2 years or Fourteen (14) children, with no more than three infants (birth to 24 months) and at least two of the children with 1 child enrolled in kindergarten and 1 child at least six years of age with landlord consent (LIC 9149). A Large Family Child Care Home license may be issued upon final file review and corrections to the following: -Remove wood pile from backyard -Place a door safety latch on the doorknob of bathroom 2 -Cover barbecue grill with a longer cover or secure the cabinet doors on the bottom of grill with a lock During the exit interview, Licensee, Danelie Saint Phat Cham confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A Notice of Site Visit (LIC 9213) was given to Licensee, Danelie Saint Phat Cham and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
