What the inspector wrote

On 05/15/2025, at 2:45 PM Licensing Program Analyst (LPA), Oscar Picazo conducted an unannounced Plan of Correction (POC) inspection. Upon arrival, LPA met with licensee, Dolce Noel and disclosed the purpose the inspection. The purpose of this inspection is to ensure that the deficiencies cited during the annual random inspection on 04/11/2025 were corrected. Per LPA request, Licensee proceeded to produce the day care children's' files. There were 7 children in care during this inspection. Jonette from Interpretation Services provided Haitian Creole interpretation. The following deficiencies have been corrected as follows: Licensee has cleared all trash and broken furniture from the back yard as well as cleared all stacked household furniture, appliances, electronics and miscellaneous items for sale from children's outdoor play area and made them inaccessible to the children. The licensee obtained a Fire and Natural Disaster Drill log and conducted and documented one (1) fire drill and one (1) earthquake drill on 04/14/25. Licensee has acquired immunization records and completed children\342\200\231s immunization record forms for all children in care. LPA reviewed and determined to be completed. Licensee obtained and posted the PUB 394 Parents' Rights Poster in a prominent publically accessible area within the Family Child Care Home. Licensee obtained an LIC 700 and documented in each child's record, a copy of the emergency information card as required in Section 102417(g)(7). See LIC 809C Continuation... LPA inspected and observed that the licensee cleared all trash, debris and broken furniture, as well as cleared all stacked household furniture, appliances, electronics and miscellaneous items for sale from the children's outdoor play area and made them inaccessible to the children. Licensee presented a Fire and Earthquake Natural Disaster log which documented the last drills were conducted on 4/14/25. Licensee is also displaying an LIC 9148 Earthquake Disaster Preparedness checklist and the PUB 394 Parents' Rights Poster in a prominent publically accessible area. LPA also viewed 7 of 7 day care children's immunization records and determined they are complete and meet regulation. LPA discussed, reviewed and provided title 22 regulation section: 102417(g)(9)(A)1 Operation of a child care home, 102418(g) Immunization, 102419(b) Auth Reps Rights, 102421(b) Child's Records. 102417(g)(9)(A)1 The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department... (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months. 1. The licensee shall document the drills, including the date and time of each drill. This documentation shall kept at the family child care home. 102418(g) The licensee shall document each child's immunization as required by the California Code of Regulations, Title 17, Section 6070, and shall maintain such documentation for as long as the child is enrolled. 102419(b) The licensee shall post the PUB 394 (8/02), Family Child Care Home Notification of Parents\342\200\231 Rights Poster in a prominent, publicly accessible area in the family child care home at all times children are in care. 102421(b) The licensee shall maintain, in each child's record, a copy of the emergency information card as required in Section 102417(g)(7). Licensee Dolce Noel stated he understands and will comply with the cited regulations. On 11/12/2024, licensee submitted an application for a large license for up to 14 children. A fire clearance for 14 children was granted on 12/05/2024. During today\342\200\231s inspection, LPA observed the facility has ample space to care for up to 14 children. Licensee stated he has an assistant that has all the required documents to work at this facility. LPA reviewed capacity for a large license for up to 14 children. Landlord had previously given consent for a large license and LIC 9149 is on file. The maximum capacity for a large family child care home: 12 children (with a qualified assistant) with no more than 4 infants; or (with landlord consent) 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there are no Qualified Assistants present, the capacity reverts to the requirements for a Small Family Child Care. A Notice of Site Visit (LIC 9213) was given to licensee, and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Appeal Rights (LIC 9058) were provided. A large family childcare home license may be issued upon final file review. Exit interview was conducted with Licensee, Dolce Noel. Jonnette from Interpretation Services provided interpretation in Haitian Creole. Dolce Noel stated he understood.
