What the inspector wrote
On 05/01/25 at 1:30 PM Licensing Program Analyst (LPA) Oscar Picazo conducted an announced pre-licensing inspection with applicant Susana Rubio Martinez. LPA discussed the purpose of the inspection and was granted permission to tour the facility by the applicant. The tour of the family childcare home was led by the applicant. The purpose of the inspection is to ensure that the home follows standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. This 2-story 3-bedroom, 2-bathroom home was toured and inspected. The hours of operation are: Monday through Friday from 7:30 AM to 5:00 PM. The day care areas include: the living room, hall bathroom # 1 and the front yard. The off-limit areas during childcare hours include: kitchen, bedroom #1, bedroom #2, stairs leading to the 2nd floor, bedroom #3, bathroom #2, laundry room, the drive way, east side yard and back yard. These areas are made inaccessible to children with the use of child proof fixed and retractable gates, doorknob covers, and a latching gate. Applicant will utilize the front yard for outdoor activities. LPA observed that the front yard was fully fenced at the time of this inspection. LPA informed applicant to ensure children are supervised at all times during outdoor activities.
Applicant states and LPA observed that there are no bodies of water on the premises. There are 5 smoke alarms and 2 carbon monoxide detectors that meet requirements, were tested and are in working order. The fire extinguisher is rated 3-A:40-B-C and is located on the entrance wall. The applicant states there are no firearms, no other weapons, or ammunition in the home. Cleaning compounds and poisons are in locked in a cabinet that is inaccessible to children. Applicant has working telephone service. Applicant has an ample amount of age-appropriate toys, books, play equipment/structure and materials available for the range of day care children. Applicant states isolation area for sick children will be in a corner activity area in the living room; healthy children will remain distanced in the living room care area and will maintain visual contact with both sick and healthy children.
Because the applicant rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The applicant also obtained
a signed Property Owner/Landlord Consent form (LIC 9149).
On this date, 05/01/25, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility address. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.
Applicant has completed the Mandated Reporter AB1207 training certification on 02/03/25. Applicant was advised that all helpers will need to complete this training. Applicant has completed the 8 hours of preventative health practices on 03/06/25 as well as the Pediatric CPR on 09/29/23 and First Aid certifications on 10/31/25. Applicant was advised all helpers will need to complete this training if left alone with children. Required documents are posted. Applicant and all adult residents in the home have all received criminal record clearances on file. Immunization records were reviewed.
Applicant was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
LPA advised that prior to making alterations or additions to the home or grounds, the applicant shall notify the Department of the proposed change. Applicant states they are financially secure to operate a family child care home for children and will comply with all regulations and laws governing family child care homes.
LPA reviewed with the applicant the LIC 311D and New Provider Resource Packet which includes information on the following: Safe Sleep, Lead Exposure, SIDS, shaken baby, child abuse reporting, community resources, children\342\200\231s records, facility records, required postings, immunization, unusual incident report, facility roster, car seat law, visual for ratio/capacity, fire/disaster drill log and discussed California Megan's Law and LPA provided the following:

Applicant was also informed the following items are prohibited during day care operating hours: walkers, exersaucers, jumpers and johnny bouncy seats. Corporal punishment and smoking are also not allowed in the day care.

An Individual Infant Sleeping Plan [LIC 9227

shall be maintained for each infant up to 12 months of age.
Licensee shall place infants up to 12 months of age on their backs for sleeping.

, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the maximum capacity for a large family child care home: 12 children (with a qualified assistant) with no more than 4 infants;
or
(with landlord consent) 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there are no Qualified Assistants present, the capacity reverts to the requirements for a Small Family Child Care.
A large Family Child Care Home license may be issued upon final file review.
An exit interview was conducted with the applicant, Susanan Rubio Martinez. The report was reviewed and a copy of the report and appeal rights (LIC 9058) was provided to applicant.
