What the inspector wrote

On 03/21/2023 at 12:01pm, Licensing Program Analysts (LPAs) Selina Siao and Samantha Clinesta conducted a case management for the purpose of capacity decrease as facility has applied for a school age license. Upon arrival, LPAs Siao and Clinesta met with Director Leslie Scheck and conducted a census count of the children in care. There are 72 children in care supervised by 16 staff members in 8 classrooms. The children were also observed in the upstairs multipurpose room (Beit Midrash) for PE due to the rain. Director stated that the facility has been using that room as a large motor area on raining days. Appropriate ratios were observed, and all staff members have the required background clearances and are associated to the facility. The facility currently operates Monday to Friday from 8:00am to 4:30pm. This facility is currently licensed for 145 children ages 18 months to Kindergarten along with having up to 12 school age children in rooms #3 to #11. Facility has a toddler option to care for up to 12 toddlers (ages 18-36 months) in room #2. Licensee representative submitted an application to the department to increase the toddler option to 26 toddlers by adding classrooms #3 and 4. Also facility has requested to have up 99 preschool age children ages 2-5 in classrooms #5-11. The toddler rooms #2-4 were previously measured at 1594.57 square feet, which is more than sufficient to accommodate up to 26 children. The preschool rooms #5-11 were previously measured to be 3485.18 square feet, which is sufficient for up to 99 children. The rooms are equipped with age appropriate equipment, furniture, supplies and materials. There are a total of 12 sinks and 10 toilets available for preschool and toddlers. Drinking water is available for the children in and outside the classroom. The children has there own water bottles while they are inside and outside. Children are to be escorted and supervised by staff to and from the restrooms. Direct visual observation is required when children are in care. The Temple Solel has a circular empty fountain located in the main courtyard area adjacent to the preschool office. Director stated that the fountain will be demolish. When children pass through the area to go on field trip or the sanctuary, facility staff shall provide direct supervision at all times. LPAs remeasured the toddlers playground, Yard 1 and Yard 2 playgrounds today. The toddler playground is measured at 1004.20 square feet, which is sufficient for 13 children. There is rubber cushioning under the climbing structure at the toddler playground. The Yard 1 is measured at 3456 square feet and Yard 2 is measured at 1775.5 square feet which is sufficient for up to 69 children. There is sand under the climbing structure at Yard 1 and rubber cushioning under climbing structure at Yard 2. There are multiple tarp and trees use as shade throughout the playgrounds. The playgrounds have age appropriate equipment. Director submit an updated sketch to reflect the changes and also include the upstairs multipurpose room (Beit Midrash) and the sanctuary area that are use for children. The following items are needed prior to granting the change of capacity: Submit an outdoor playground waiver for the preschool and toddler yard due to not having sufficient outdoor activity space. Submit an outdoor playground waiver for Yard 2 as it will be shared with the school age children. Submit a share space waiver for the Beit Midrash and the sanctuary spaces that are use for the toddlers, preschooler and school age children. . Obtain an updated fire clearances for all the indoor activity areas that are use for the children. See LIC809D for type B citation issue: Notice of site visit was posted during today's inspection and it must remain posted for 30 days. Failure to keep it posted will result in $100 civil penalty.

This requirement is not met as evidence by: LPAs Siao and Clenista observed the day care children using the upstairs multipurpse room "Beit Midrash" for PE due to the rain. The area is not an approved area for the children in care. This poses a potential health and safety risk to children in care.
