What the inspector wrote

On 11/21/2024 Licensing Program Analysts (LPA\342\200\231s) Kelly Gerth and Sumayya Habeebulla arrived unannounced at the facility to conduct an annual inspection as part of a compliance review. Upon arrival, LPA\342\200\231s met with Preschool Teacher Elsa Campos, at approximately 10:30 am Director Danielle Strickland arrived. This is a combination childcare center, and the other licensed program is 376700207, which was also inspected on this date. A tour of the inside and outside of the facility was granted and the following was observed and/or noted: \302\267 The following items were posted and updated where necessary: - License - Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148) - Parent\342\200\231s Rights Poster (PUB393) - Personal Rights (LIC613A) - Child Car Seat Law - Menu \302\267 The facility is operating within the limits as stated on the license. \302\267 Ratios are being met during this inspection, 1 staff and 6 Preschool children were present. \302\267 Classrooms are adequately equipped with age and size appropriate furniture and equipment \302\267 There are no weapons present at the facility as stated by Director Danielle Strickland. \302\267 There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position. \302\267 Drinking water is provided in the indoor activity space and the outdoor activity space by filtered water supply and plastic cups with children\342\200\231s names labeled. \302\267 Medications are stored where inaccessible to children See Next Page Page 2/4 \302\267 Hazardous items are stored where inaccessible to children which include disinfectants, cleaning solutions. \302\267 Poisons and toxins are locked and inaccessible to children \302\267 All floors were observed to be clean. \302\267 Bathrooms were observed to be in operating condition \302\267 Playgrounds are enclosed by appropriate fences and are not free of hazards, a citation will be issued. \302\267 Outdoor activity areas are supplied with age and size appropriate equipment, some in less than good condition, a citation will be issued. Food preparation area is cluttered with an opened bottle of water alongside cleaning supplies, on the kitchen counter. A citation will be issued. All storage containers for solid waste observed to have tight-fitting covers, kept on. \302\267 Sign in/Sign out record was reviewed and meets regulation requirements \302\267 Disaster drills conducted at least every six months \342\200\223 last drill conducted on 07/16/2024 A review of staff and children's records were conducted as part of this evaluation. \302\267 Children\342\200\231s records were found to be complete during this inspection. \302\267 Staff record review indicates that all staff present meet minimum qualifications for the position for which hired \302\267 A staff member is present with current Pediatric CPR/First Aid which expires on 10/25/26 \302\267 Opening and closing staff member\342\200\231s CPR/First Aid expires on 10/05/26 \302\267 Director completed Health and Safety Training, September 2002 \302\267 A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Director Danielle Strickland was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 , requires all licensed Childcare Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP)LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPA referred Director Danielle Strickland to the Department website for lead: Lead Toxicity Prevention and Water Testing Information. This facility provides Incidental Medical Services \342\200\223 IMS. LPA reviewed storage of \342\200\234medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. Currently no children in care have medications prescribed. The Duty Officer is available to answer questions Monday \342\200\223 Friday; 8:00am to 5:00pm at: 951-782-4200 Director Danielle Strickland was asked to update the following documents, if applicable, and submit to licensing within 30 days: 1. LIC 500 Personnel Report 2. LIC 610 Emergency & Disaster Plan 3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule (only if changes have been made or file copy is more than 2 years old) 4. LIC 309 Administrative Organization (only if changes have been made or file copy is more than 2 years old) 5. LIC 308 Designation of Administrative Responsibility (only if changes have been made & current designation is on file) See LIC809-D for cited deficiencies During the exit interview, the Director Danielle Strickland confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and this report was reviewed with the Director Danielle Strickland. Appeal rights were discussed and provided during the exit interview.

    Based on observation the licensee did not comply with the section cited above in 1/1 counts where LPA's observed S4 alone with 6 children in outdoor activity area, using a hand held device, not supervising children in care which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation the licensee did not comply with the section cited above in 2 identifiers where upon entrance to the outdoor activity space, LPA observed a pair of dirty child sized underpants at the front gate and Inside the center of the outdoor activity space, wooden beam approx. 3.5 feet in length and worn cardboard boxes placed as ground covering were observed. which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation upon entering the inside preschool side of CCC, LPA observed clutter of toys, materials, furniture, supplies stacked and placed throughout the entrance which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation the licensee did not comply with the section cited above in 9/9 nap mats in the preschool classroom had ripped/torn/exposed foam in nap mats used by children in care, which poses/posed a potential health, safety or personal rights risk to persons in care.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    Based on observation the licensee did not comply with the section cited above in 3 identifiers where LPA observed a wooden Garden box containing 3 rusted screws protruding from the corners, a Rusted pipe with 3 ends tied to a rope hanging from fence play yard fence, reachable by children and a baby gate zip tied to top of play structure to prevent use of slide, had a large hole in the center of the plastic with jagged edges, which poses/posed a potential health, safety or personal rights risk to persons in care.
