What the inspector wrote

p. 2 The Director also confirmed that there are cameras located throughout the child care center; however, the system provides live video only and does not have playback capabilities. Therefore, even if a parent had requested video footage—which the Director stated has not occurred—the request could not be fulfilled due to the system’s limitations. Additionally, LPA Gerth conducted observations in the classrooms and during outdoor playtime. During these observations, all staff interactions with children were appropriate, and no concerning behaviors were noted. Therefore, based on evidence collected, files reviewed, observations made and interviews conducted, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. Regarding the allegation that staff yelled at a child in care, on 03/23/2026, 03/25/2026, 03/26/2026, and 04/01/2026, LPA Gerth conducted and/or attempted to conduct interviews with all relevant parties pertaining to the allegation. Information obtained through interviews indicated that while the child care center can be loud at times—particularly in certain areas due to the facility layout—staff reported they have not heard any teachers yell at children. During the interview process, it was also disclosed that some parents have noted that certain staff may have naturally loud speaking voices; however, no concerns were raised indicating that staff used an inappropriate, harsh, or punitive tone when interacting with children. Additionally, during the visit on 03/23/2026, LPA Gerth conducted observations both indoors and outdoors. Throughout these observations, staff were noted to use appropriate tone and volume when speaking with children in care, and no inappropriate interactions were observed. Based on interviews conducted, observations made, and evidence gathered, LPA did not find evidence that the alleged violation occurred, therefore the allegation is UNSUBSTANTIATED Regarding the allegation that staff did not report incidents to the child’s authorized representative, During the course of the investigation, LPA Gerth collected and reviewed incident/accident reports and facility records pertinent to the allegation. On 03/23/2026, LPA Gerth conducted interviews with five staff members. Information obtained from these interviews indicated that all known incidents and/or accidents were documented and reported to parents/guardians using the child care center’s standard written incident/accident report forms. Staff reported they are not aware of any specific incidents or accidents that were not reported. A review of facility files supports the statements provided by staff, indicating that known incidents and accidents were appropriately documented and communicated to authorized representatives. On 03/25/2026, 03/26/2026, and 04/01/2026, LPA Gerth attempted to contact the Reporting Party to conduct an interview and obtain additional supporting information; however, these attempts were unsuccessful. p3 Therefore, based on the interviews conducted, documentation reviewed, and information available at this time, there is not a preponderance of evidence to support that the alleged violation occurred. The allegation is determined to be UNSUBSTANTIATED. A copy of this report, appeal rights and Notice of Site Visit were provided to Director Evelyn Avila and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
