What the inspector wrote

On June 9, 2021 at 2:00 p.m., Licensing Program Analyst (LPA) Leilani Curtis conducted an unannounced case management inspection in reference to the Licensee\342\200\231s request for a room addition. Upon arrival LPA met with Area Manager Bridget Nichols and proceeded to tour the facility to ensure that it is safe for the care and supervision of children. Also present were 2 staff with 22 children in the following rooms: Room#201: 7 children with staff #2 (S2) Room#208: 15 children with staff #1 (S1) Room #208 was out of ratio. At 2:45 p.m. staff #3 arrived to assist in room #208. Staff members have the required background clearances and are associated to the facility. The facility is currently licensed to operate in rooms 201, 208, Library and Multipurpose Room. The licensee has requested to add rooms 203 and 606 to its license. A fire clearance for the additional rooms was granted on 06/01/21. The capacity will remain the same, 100 children in transitional kindergarten and above. The classrooms are used as elementary school classrooms during the day. Per Health and Safety Code Sections 1596.806(a), (a)(1), (a)(2) and (d) this program is exempt from square footage requirements. LPA inspected rooms 203 and 606. The rooms are equipped with tables, chairs and age appropriate supplies and equipment. Cleaning supplies and other hazardous items are inaccessible to children through latches, locks and/or placed on high surfaces. Check-in will take place in room #208. If child(ren) become ill during the day, they will be placed in the isolation area which is located at an outside table near the front office. Children\342\200\231s authorized representative will be contacted immediately for pick up. Drinking water is readily accessible via water fountains that Ms. Nichols stated children will utilize to refill their water bottles that they bring from home. There are several restrooms for the children to use which include toilets and sinks and afford privacy. There is a separate staff restroom. Children will be escorted to/from the restrooms at all times. Food preparation for snacks is done in room #208. The children eat snacks outside at the picnic tables. Facility has an operational carbon monoxide detector located in room #208 . The playgro und to be used is the elementary school playground, which has age-appropriate play equipment. There is shade available and a drinking fountain for refilling water bottles. Ms. Nichols is reminded to keep anything that reads, \342\200\234Keep Out of Reach of Children\342\200\235 inaccessible to children. The Multipurpose Room was observed to be not in compliance with Title 22 regulations. LPA observed several items to be stacked up on one another such as boxes and drawers. The Multipurpose Room is currently being used for storage. There are several tables and chairs stacked through out the room. The Area Manager states that they do not currently use the Multipurpose Room but would like it to remain on their license for the next school year. LPA informed Ms. Nichols that prior to having any children utilize the Multipurpose Room she must submit pictures to LPA Curtis to confirm that the hazardous items have been removed. See LIC809D for cited deficiency. ***Rooms 203 and 606 were inspected today and observed to be in compliance with Title 22 regulations. The addition of rooms 203 and 606 for childcare is granted and effective today's date, 6/9/21. The licensed rooms are as follows 201, 203, 208, 606, Library and Multipurpose Room. An updated license will be sent for posting. An exit interview was conducted and appeal rights (LIC 9058 1/16) were discussed with Area Manager Nichols. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed the Area Manager post notice of site visit. (1) A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children. This requirement was not met as evidenced by: Based on LPA's observation and staff #1's statement, staff #1 was alone with 15 children. The Area Manager failed to ensure that a staffing ratio of one teacher to 14 children was maintained. This poses a potential health and safety risk to children in care.
