What the inspector wrote

It was alleged that staff used inappropriate language with day care children. Information received stated that Staff 1 (S1) curses at day care children and make them cry. S1 and other staff members denied using inappropriately language with any day care children. Director denied not accurately maintaining day care children's records. Director denied the allegation and stated that parents are notified more than 30 days of any changes to their child’s contract. It was also alleged that staff did not remove sick day care children from the classroom. Some staff members stated that children are immediately removed from the classroom and isolated in the Director’s office. A few staff members stated that the children are isolated in the classroom while other staff members stated that sick children are not removed from the classroom. Regarding the allegation, staff pull day care children's hair. Staff members denied the allegation and stated that on occasion a child will ask staff to put their hair up into a ponytail, however that is the only time the child’s head is touched. Day care children interviewed did not disclosed being pulled by their hair. Based on conflicting information obtained and no collaborating evidence to support the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are determined to be unsubstantiated. No deficiencies cited. A copy of this report along with Appeals Rights were provided. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted with Director, Jacqueline Serrano.

This requirement was not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as the personal rights of children in care were not accorded as Staff (S1) was observed yelling at children which poses a potential health, safety or personal rights risk to persons in care.
