What the inspector wrote

On the above date and time, Licensing Program Analysts (LPA\342\200\231s), Kelly Gerth and Kelly Waters, conducted an unannounced Case Management inspection for program capacity and room change. Upon arrival, LPA\342\200\231s met with Director Kyara Mieritz and provided the purpose of the visit. Licensee is currently licensed for 42 preschool children ages 2-5 yrs old in classrooms 1, 2, 4 and 5 and for 12 school age children in room 3, with a total capacity of children not to exceed 54. Licensee\342\200\231s Application is requesting to be licensed for a total of 54 preschoolers ages 2-5 years old in classrooms number 1, 2, 3 and 5, with the removal of room 4 for a separate private school age kindergarten use and removal of school age use in room 3. Hours of operation will be Monday through Friday, 7:00 am-5:30pm. Present during today\342\200\231s inspection were (34) preschool children with (5) staff. Appropriate ratios and supervision were observed. All indoor and outdoor activity space utilized for the children was inspected today. LPA\342\200\231s informed Director Kyara Mieritz that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. LPA\342\200\231s continued to tour the facility and measured indoor and outdoor activity space. Total indoor activity space measured for Rooms 1, 2, 3, and 5 is 3,671.68 square foot, which is sufficient to accommodate the requested capacity of (54) Preschool Children. LPA\342\200\231s observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, bookshelves, and other activity supplies for the children. LPA\342\200\231s observed all hazardous items to be inaccessible to children. There are no bodies of water or weapons on the property. Fire clearance was granted on December 10, 2025. A shared restroom waiver with the separate private school age Kindergarten program shall be submitted and approved prior to licensure. LPA observed a total of (11) sinks, (7) toilets and (2) urinals (1 urinal currently out of service) available for children\342\200\231s use. These are sufficient to accommodate the requested capacity of (54) preschool children. Page 2 The facility currently has a fully enclosed playground area, with wall and fencing enclosure at least four feet high. The total square footage for all the outdoor activity space is 10,171.50 square feet, which is sufficient to accommodate the requested capacity of 54 preschool children. A playground waiver to share the playground at different times with the separate private school age Kindergarten program shall be submitted and approved prior to licensure. Shade is provided via two permanent shade structures and one portable pop-up shade structure. There are sufficient outdoor age-appropriate toys and play equipment available on the playground. There is a climbing structure and swings on the playground for children aged 2-5 years old, which is properly anchored. There is adequate cushioning in fall zones of climbers provided by sand. Drinking water is available in the classrooms and outdoor space via filtered water pitchers, children\342\200\231s personal water bottles and/or disposable cups. LPA observed all hazardous items on the playground to be inaccessible to children. Director Kyara Mieritz was reminded that any changes to the facility must be reported to and approved by Community Care Licensing. Director Kyara Mieritz was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The following corrections are needed prior to the issuance of the requested change of license: 1. A playground waiver to share the playground at different times with the separate private school age Kindergarten program shall be submitted and approved prior to licensure. 2. A shared restroom waiver with the separate private school age Kindergarten program shall be submitted and approved prior to licensure. Director Kyara Mieritz understands that all proof of corrections must be provided to the Department within 30 days, or the application may be denied. A notice of site visit was given to Director Kyara Mieritz and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
