What the inspector wrote

In interviewing all four parents, P3 stated that they had witnessed S2 yelling at another child in care to leave another child alone. Other parents who were interviewed also stated they had witnessed S2 yelling at children in care and P4 stated her child told her this staff member yelled at them directly. LPA also interviewed three children and each child stated they do remember this staff member yelling at other children in care and C4 remembers when S2 yelled at them regarding an incident. C4 stated this made them feel upset and embarrassed while C3 stated it made them feel mad and C1 stated the yelling made them feel sad and jumpy. Based upon my interviews with staff, parents and the children in care, and observation of the behavior of the staff member during my own attempt of an interview, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, divisions 12 & Chapter 1 Article 6, Personal Rights 101223(a)(1) are being cited on the attached LIC 9099D. A copy of this report will be emailed to Manager, Jasmine Reaves. A return email acknowledging the receipt of this report will be used in lieu of a signature due to the COVID-19 pandemic. Due to the COVID-19 State of Emergency, this report was completed via Tele-Inspections Report Delivery Instructions

    101223(a)(1) Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons.This requirement was not met as evidenced by: Based on observations and interviews conducted, LPA has verified through interviews each person has witnessed this staff member yelling at children in care. This conduct caused the children to feel upset, embarrassed, sad, mad, and jumpy.This poses a potential risk to the health and safety of children in care.
