What the inspector wrote

On 07/01/2024 at 3:30 PM , Licensing Program Analysts Gabriela Hernandez and Kelly Gerth , conducted a Case Management visit in response to information received from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). LPA met with Director Delaney Villani who was informed of the reason for the visit. Assembly Bill 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers constructed before January 1, 2010, to test their drinking and cooking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first lead testing. Director notified LPA's the CCC was reconstructed in approx. 2013. Even though the facility was constructed after 2010, LPAs received notification from SWRCB regarding high levels of leads. LPA\342\200\231s Gabriela Hernandez and Kelly Gerth interviewed the Director, staff and examined the faucet deemed an Action Level Exceedance. During inspection, Director provided LPAs with facility sketch, the required signed and dated forms (LIC9275/9276). LABEL Q: Faucet reported with 24.1 ppb or greater lead exceedance levels were as follows LABEL R: Faucet reported with 8.94 ppb or greater lead exceedance levels were as follows The double faucet sink (Labeled Q and R) are located in the school age classroom identified as Clubhouse and or classroom Number 6. Director Delaney Villani informed LPAs that to her knowledge the faucet is used only for hand washing. Interviews with 3 of 3 staff members (S3,S4, and S6) revealed they have not used the water source for drinking water for children in care, however they have not been informed if the water source is allowed for drinking use. See LIC 809D for cited deficiency in accordance with the California Code of Regulations Title 22, Division 12 written directives. An exit interview was conducted with Director Delaney Villai. A copy of this report, appeal rights and a Notice of Site Visit was issued.

(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidenced by: LPA Hernandez received water testing results taken on May 30, 2024 with an Action Level Exceedance of 5.9 which is higher than the allowable limit. The faucet labeled (Q and R) were located in classroom labeled as Clubhouse. This poses a potential health, safety, or personal rights risk to the children in care.
