What the inspector wrote

On May 4, 2023 at 10:30 a.m. Licensing Program Analyst (LPA), Leilani Curtis, conducted an unannounced case management inspection. LPA met with Director Valerie Rodriguez and proceeded to tour the facility. There were 12 children with 3 staff members present. Appropriate ratio/capacity was observed. Staff members have the required background clearances and are associated to the facility. The director states that on 3/24/23 a staff member (S1) left a child (C1) unattended on the playground. LPA interviewed staff #2 (S2) and the director. On 3/24/23 at approximately 9:00 a.m. S1 and her class were transitioning from the playground back into the classroom. S1 entered the classroom with her students, closing the facility door behind her. S1 left one child (C1) alone, outside on the playground for approximately 3-4 minutes. C1 was not injured or harmed. The parent of C1 was not notified of the incident. Director Rodriguez states that S1 is no longer employed at the facility. The director also states that she did not notify Community Care Licensing or the parent/guardian of C1 of the incident because she was not aware that she was required to do so. LPA Curtis informed Director Rodriguez that this report dated 5/4/23 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Curtis informed Director Rodriguez to provide a copy of this licensing report dated 5/4/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This requirement was not met as evidence by: Based on record review and Director statement, the director did not notify the Department that a child (C1) was left unattended/unsupervised on the the playground, on 3/24/23. This poses a potential health, safety or personal rights risk to children in care.

This requirement was not met as evidenced by: Based on the director's statement, the parent of C1 was not notified that the child was left unattended on the playground on 3/24/23. This poses a potential health, safety or personal rights risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1) Responsibility for Providing Care and Supervision: (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews with the director and staff #2. Staff #1 (S1) left child #1 (C1) unattended on the playground for approximately 3-4 minutes on 3/24/23. This poses a immediate health, safety or personal rights risk to children in care.
