However, it was undetermined how child #1 sustained the bruising to his left shoulder due to conflicting information provided. It is unclear whether the teacher #1 inappropriately disciplined or restrained child #1. The teacher #1 denied the allegation and stated she did not inappropriately discipline or restrain child #1. The Facility Representatives and the staff denied the allegation and stated no child was inappropriately disciplined or restrained. The interviews revealed that child #1 was thrashing himself on the cot, flailing his arms and having a tantrum as child did not want to nap. The witnesses stated child #1 was not restrained or inappropriately disciplined. The day care parents stated they did not have any concerns or issues with the staff or the facility. Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegation that \342\200\234Provider inappropriately disciplined day care child\342\200\235, therefore the allegation is found to be UNSUBSTANTIATED meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Amanda Lundy. The Director was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
