What the inspector wrote

Record reviews revealed that 1:6 facility teacher files did not meet the full requirement for a preschool teacher and this one staff works alone unsupervised with children. This Department has investigated the allegations; unqualified staff providing care and supervision to day care children. Based on LPA’s review of facility records, interviews with outside sources, the director, teachers and parents, as well as LPA’s observations and facility inspection, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Deficiencies are cited per California Code of Regulations, Title 22, Division 6 on the attached 9099D. An exit interview was conducted, and report was reviewed with Director, Spencer. A notice of site visit was given and must remain posted for 30 days. It is also alleged that children are left in soiled clothing and that children are being left in soiled diapers for a long period of time. Based on interviews conducted with parents and teachers, as well as the parent handbook, parents are asked to provide clothing for their children which is kept at the facility in the child’s personal cubby space. If the parent did not provide clothing, then the facility has spare clothes for children to use. If there was nothing available, then parents are called and advised to pick up their child. Additionally, based on interviews with teachers and parents as well as record review of a diaper changing log, infants are checked and changed throughout the day. Diaper log revealed dates, times and diaper status of all checks and changes proving that children are not left in soiled diapers for an extended period of time. Lastly, it is alleged that staff are not washing day care children’s hands. Based on interviews with the director, staff and parents as well as LPA’s observations, staff do wash children’s hands at arrival, before/after meals/snacks, after bathroom breaks, and after activities. Children wash their hands between 7-12 times per day, depending on the classroom and activity. This agency has investigated the complaint alleging facility is operating over ratio, day care children’s clothes are soiled, children are left in soiled diapers for a long period of time, and staff are not washing day care children’s hands. The Department has found that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. An exit interview was conducted and report was reviewed with Director, Shannon Spencer . A notice of site visit was given and must remain posted for 30 days.
