What the inspector wrote

On 3/17/2025 @ 11:02AM, Licensing Program Analysts (LPAs) Nancy Diaz and Jody Dye conducted an unannounced inspection in reference to a self-reported incident involving a 3-year old child who was injured in the classroom when a fish tank fell onto the child's head. This incident resulted to the child being taken to the emergency room and received stitches to her injury. A tour of the classrooms were conducted with Site Director Amber Guttierez (Mailloux) and Ass't Director, Giavana Aguilar. Observed present today were 28 preschool children in 3 classrooms with staff J. Rosa Davis, J. Baccardi, P. Farmer, K. Siekmann, C. Richardson, G. Valle, J. McMillan & J. Bagalini. Type A and B deficiencies were cited today. Type A deficiency if not corrected poses an immediate risk to the health, safety or personal rights of children in care. Type B deficiency if not corrected poses a potential risk to the health, safety or personal rights of children in care. Exit interview was conducted with Ms. Guttierez. LPA reviewed and provided a copy of this report with Ms. Guttierez. Appeal rights were also given. Notice of Site visit and copy of licensing report must be posted for 30 days. LPA Nancy Diaz informed licensee facility representative Amber Guttierez that this report dated March 17, 2025 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Nancy Diaz informed the facility representative to provide a copy of this licensing report dated March 17, 2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. See LIC 809D for deficiencies HSC Section 1596.8595© shall be cited for failure to provide copies to parents/guardians of children in care and newly enrolled children, and for failure to maintain written verification of receipt of, licensing reports indicating a Type A violation.

The name of the child care center director, and any fully qualified teacher..... shall be reported to the Department within 10 days of a change of child care center director or designee(s).This requirement was not met as evidenced by: Based on interview, Site Director Amber Guttierez was promoted to a Director position sometime in 2024. Licensee failed to report this changed to the department.

    PERSONAL RIGHTSTo be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: Based on interview and document reviewed, a 3-year old child was taken to emergency and received stitches. A fish tank that was placed on top of play refrigerator fell on top of child. It was noted that the refrigerator was not safely braced to the wall. LPAs also observed several shelves and aquariums that were not anchored to the wall.
