Inspector’s narrative

What the inspector wrote

Facility Representative stated that a child will be sent home if the bite breaks the skin or if it occurs three or more times in one day for the safety of the other children. Facility Representative also stated that she is aware that several children engage in biting and that there is one family currently on a behavior plan. Staff interviews indicated that they use verbal and physical redirection to intervene when biting occurs between children; however, they explained that biting is not truly preventable because it can happen very quickly and may be triggered spontaneously. Staff also stated that they report all incidents to the parents and submit photos and have attended parent meetings to establish plans for the child. Daycare parents reported that their child or children have been bitten at the center more than once and did not disclose any concerns of supervision. Based on the interviews and records reviewed during the course of the investigation, there were no corroborating statements or evidence to prove that there was a lack of supervision. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted and this report was reviewed with Facility Representative, Janessa Richardson.

    (a) licensee shall ensure that each child.... personal rights:(3)To be free from corporal or unusual punishment, infliction of pain,...or other actions... : interference with functions of daily living including eating, ...; or..., clothing, medication or aids to physical functioning.This requirement was not met as evidenced by: Based on video footage and interviews, the licensee did not comply with the section cited above in demonstrating Staff #1 pulling Child #1's hair and grabbing by an arm to remove them behind her from her presence which poses an immediate health, safety and personal rights risks to children in care.
