What the inspector wrote

On 06/11/2024, at 8:50 a.m., Licensing Program Analyst (LPA) D. Sanchez, conducted an unannounced Case Management to complete follow up for an Unusual Incident/Injury Report received in the San Diego Child Care Regional Office (SDCCRO) on 03/01/2024. The incident investigation was conducted by an investigator from the Department’s Investigations Branch. During the course of the investigation, interviews were conducted with facility staff and representatives from outside agencies, the facility was toured, and facility records and police reports were reviewed. Based on interviews conducted and records reviewed, it was determined that on or about 02/21/2024 and 02/25/2024, an individual associated to the facility engaged in inimical conduct with a minor, unaffiliated to the child care center. It was determined the incidents occurred on the property, but not in areas licensed for child care. On 02/28/2024, the individual was placed on administrative leave and their employment was terminated on 03/26/2024. In addition to the Department’s investigation, the licensee conducted their own internal investigation with a contracted outside investigator. The investigation also revealed that the campus security guard carried a firearm on his person while performing his duties on the facility property, which was not approved by the Department. No other violations were noted. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D). An Immediate Civil Penalty in the amount of $500.00 is being assessed for the presence/accessibility of a firearm on the premises of a child care center. Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 was given to licensee. An exit interview was conducted with assistant director Samantha Deluca. Director was provided a copy of their appeal rights (LIC 9058) This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
