What the inspector wrote

It was alleged that staff does not ensure sufficient light fixtures are provided for the safety of persons in the child care center. Facility Representative and staff stated that they feel that the classrooms are dark during nap time; however, they do not feel that the classrooms are unsafe. Some staff members stated that they feel that the classrooms are dark and unsafe during nap time. On 8/4/2025, LPA observed classroom 105 to be dark during nap time, the curtains were drawn and there was a small lamp on the teacher’s desk however, the napping children were not clearly visible and there was not sufficient lighting in the classroom. It was alleged that Licensee does not ensure staff records are properly maintained. Facility Representative stated that she was not aware that immunization records for Staff #1 (S1) were not on file. LPA’s review of records for S1 confirmed that she began employment at the facility on 7/22/2025 and did not have immunization records on file. In addition, it was alleged that staff does not ensure that parents sign in and sign out. Facility Representative and staff denied the allegation and stated that parents are signing children in and out of the facility on the sign in and sign out sheets in the classroom; however, acknowledged that staff were signing the children in and out of the facility using the Brightwheel App. LPA reviewed the facility’s sign in sign out sheets and the Brightwheel App sign in and sign out records for the period of 6/30/2025 – 8/1/2025. LPA’s review of sign in and sign out sheets and Brightwheel App sign in and out records determined that 10 out of 34 children were not signed out of the facility by their parent or authorized representative using either sign out method. A review of the Brightwheel App sign in and sign out records determined that 10 out of 34 daycare children were signed out of the facility by staff during the period of 6/30/2025 – 8/1/2025. Based on interviews with facility representative, staff members, daycare children, daycare parents, LPA’s observation, review of staff records, Brightwheel App and facility sign in and out sheet s the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Facility Representative and staff stated that the facility was cited on 6/11/2025 for not meeting Title 22 Regulations section 101216.2 Teacher Aide Qualification and Duties, the staff members in question have completed course work requirements. LPA reviewed staff qualification for the staff including the staff in question and course requirements are complete. It was alleged that s taff falsified records. Information received indicated that staff were asked to sign parent signatures to attendance sheets from an outside agency for daycare children enrolled at the facility. Facility Representative and staff in question denied requesting any staff to falsify attendance sheets from an outside agency. It was alleged that staff does not ensure that children are drinking from their own water bottles. Facility Representative and staff denied the allegation and stated that the water bottles table is monitored by staff to ensure that children drink from their own water bottles. Staff stated that the younger children attempt to grab other children’s water bottles on occasion. It was alleged that staff allows children to remain in soiled clothing for extended periods of time. Facility Representative and staff denied the allegation and stated that children are taken to the restroom as often as needed, and on a scheduled basis. Staff stated that extra clothing is also provided by parents and the facility staff in the event a child’s clothing is soiled. It was alleged that staff do not ensure children are checked for signs of illness during drop off. Facility Representative and staff members denied the allegation and stated that daily health checks are conducted upon the arrival of children at the facility. Staff stated that children are observed upon arrival for fatigue and symptoms of illness. It was alleged that staff do not contact the parents of children that are ill. Facility Representative and staff members denied the allegations and stated that sick children are not allowed to remain at the facility. Daycare parents interviewed stated that they are contacted by phone and through the Brightwheel App if their child becomes ill. See LIC 9099C Continuation... In addition, it was alleged that staff allow children to play on a play structure that is not age appropriate. Facility Representative and staff denied the allegations and stated that children only are allowed to play on the play structures that are age appropriate. Based on interviews conducted with facility representative, staff, daycare children daycare parents, facility sign in/sign out sheets, Brightwheel App, and related documentation, there were no disclosures that corroborated the allegations. Due to conflicting interview statements, the allegations are found to be unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. This requirement is not met as evidenced by: Based on interview and observation, the licensee did not comply with the section cited above in that LPA observed that classroom 105 was dark during nap time and there was not sufficient lighting which poses a potential health, safety or personal rights risk to persons in care.

    (a) (1) Commencing September 1, 2016, a person shall not be employed...at a day care center if he or she has not been immunized against influenza, pertussis, and measles...This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in that immunization records for S1 were not available for review during time on inspection which poses a potential health, safety or personal rights risk to persons in care.
