What the inspector wrote

LPA was advised of the director change in August 2023 and LPA requested the documents be sent to CCL during the visit. Based on confidential interviews and records review, the preponderance of evidence has been met and the allegation that licensee does not ensure a qualified director is present during operating hours is substantiated. The facility is cited for Title 22, Section 101215.1(f)(1) Child Care Center Directors Qualifications and Duties which poses a potential health, safety and/or personal rights risk to children in care. An exit interview was conducted, a copy of this report, appeal rights and Notice of Site Visit were provided to Director. The director was reminded that the Notice of Site Visit must remain posted for 30 consecutive days. During multiple visits to facility, LPA observed that the facility was operating within ratio, was adequately staffed and supervising children at all times. LPA also conducted a review of the child’s records and noted that there were several “ouch reports” on file because the child had behaviors that resulted in child injuring self or others. In addition, LPA observed that staff witnessed and were present when the incidents occurred and the child was immediately provided aid as necessary. Regarding the allegation that staff are not meeting day care children's diapering needs, it was alleged that a child has had frequent diaper rashes due to the staff not wiping or changing child frequently enough. Confidential interviews disclosed that the CCC’s practice is to check all children’s diapers every hour and to change the diapers every two hours even if the diaper was not soiled. Records review revealed that the CCC does keep diapering logs to show when the diaper is checked or changed. LPA reviewed the diapering logs and was able to verify that the children’s diapers are being checked and changed as stated. Due to information gathered, LPA was unable to corroborate this allegation. Based on confidential interviews, the allegations that staff do not provide adequate supervision resulting in a day care child sustaining multiple injuries and staff do not meet day care children’s diapering needs, may have occurred, however is not supported or proven by evidence. Therefore, the allegations are unsubstantiated. An exit interview was conducted, a copy of this report, appeal rights and Notice of Site Visit were provided to Director. The director was reminded that the Notice of Site Visit must remain posted for 30 consecutive days.
