What the inspector wrote

Staff stated that children are taken to the restroom as often as needed and on a scheduled basis. Staff stated that the children will also notify the staff when they need to use the restroom. It was alleged that staff allowed a daycare child to engage in self-harm behaviors while in care. Facility Representative and staff denied the allegation and stated that daycare children are not allowed to harm themselves. Staff stated that if a child is expressing self-harming behaviors, staff intervene immediately to ensure the child is safe. It was alleged that staff allowed a daycare child to hit other children in care. Facility Representative and staff denied the allegation and stated that daycare children are not allowed to hit each other. Staff stated that if children are not sharing, become upset or aggressive with each other, staff immediately intervene, talk to the children and redirect the children to other activities. It was alleged that staff sleep at the facility while on shift. Assistant Director denied the allegation and acknowledged that there was incident reported to her regarding Staff 1 (S1) laying down on the floor inside of the classroom next to a daycare child, soothing the child for comfort. S1 denied the allegation and stated that she has never slept at the facility while on shift. S1 acknowledged that on one occasion, she laid down in the classroom next to a daycare child patting the child\342\200\231s back to assist the child with falling asleep. S1 stated that there was another qualified staff present inside of the classroom while she assisted the child with napping. LPA was unable to determine based on a review of related documentation submitted to the Department as evidence, if S1 was sleeping at the facility while on shift. In addition, it was alleged that staff did not report incidents to appropriate parties. Facility Representative and staff denied the allegation. Facility Representative and staff stated that incident reports are provided to daycare parents for injuries and incidents that occur at the facility. Staff stated that parents are notified of incident reports by documentation, verbally, text message, phone, in person and recently the facility has implemented the Brightwheel App. Based on review of related documentation, incident reports and interviews conducted, there were no disclosures that collaborated the allegations. Due to conflicting interview statements, the allegations are found to be unsubstantiated. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. See LIC 9099C Continuation... No deficiencies cited. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Cynthia Quintana and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Appeal Rights (LIC 9058) were provided. An exit interview conducted, and report was reviewed with Facility Representative, Cynthia Quintana.
