What the inspector wrote

On February 17, 2026, at 3:25PM, Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced Case Management inspection regarding a self - reported incident. LPA met with Facility Representative Jessica Cabalo and disclosed the purpose of the inspection. LPA accompanied by Facility Representative toured the indoor of the facility. At 4:20PM, Facility Representative Verenicia Chavez arrived to the facility. There were 13 children present, with five staff members. Facility Representative Celynn Preston reported that on December 2, 2025, between approximately 3:28PM and 4:00PM, there was an absence of supervision reported involving Child #1 (C1). Interviews were conducted with Facility Representative, Celynn Preston and former Facility Representative Cynthia Quintana, staff members, a witness, C1 and their authorized representative. LPA reviewed staff files, and obtained copies of facility roster, sign in/sign sheet and related documentation. Per Facility Representatives video footage was unavailable. Former Facility Representative Cynthia Quintana reported that on December 2, 2026, at approximately 3:30PM, she was supervising approximately 8 children on the playground when she escorted C1 to the restroom. Former Facility Representative stated that she stood in the doorway leading from the Pre-K classroom to the playground and had a visual of the restroom. Former Facility Representative stated that a daycare parent arrived to the facility to pick up another daycare child. Former Facility Representative stated that she spoke with the parent and then closed the door to the classroom. Former Facility Representative stated that C1 was still in the restroom and the door to the Pre-K classroom that leads to the playground was closed because she observed Staff #1 (S1) and her group of children entering the classroom. See LIC 809C Continuation... Former Facility Representative admitted that she did not communicate with S1 that C1 was inside of the classroom using the restroom. S1 stated that she and approximately five daycare children were passing through the Pre-K classroom transitioning to the playground, when she heard the toilet flush inside of the restroom. S1 stated that she observed C1 inside of the restroom alone. S1 stated that C1 appeared to be safe and unharmed but there were no staff present inside of the classroom or inside of the restroom. S1 stated that she immediately took C1 to the playground to former Facility Representative, Cynthia Quintana. Former Facility Representative stated that C1 was inside of the bathroom for less than one minute. Based on interviews conducted it is determined that C1 was left alone and without supervision inside of the restroom located in the Pre-K classroom for approximately one minute. Former Facility Representative Cynthia Quintana stated that C1\342\200\231s authorized representative was notified of the incident. Per California Code of Regulations, Title 22, Division 12, Chapter 1, a deficiency is being cited on the attached LIC 809D. This is a repeat violation, facility was cited on September 30, 2025, for Absence of Supervision 101229(a)(1). A $250 Civil Penalty was issued. Refer to LIC 421FC. LPA Vicky Williamson informed Facility Representative Verenicia Chavez that this report dated February 17, 2026 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Vicky Williamson informed the Facility Representative Verenicia Chavez to provide a copy of this licensing report dated February 17, 2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility Representative Verenicia Chavez.

Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in that on December 2, 2025, there was an absence of supervision resulting in C1 being left unsupervised in the restroom which poses an immediate, safety, or personal rights risk to persons in care.
