What Happened
This was a case management inspection for a requested Toddler Option expansion. The facility was found operating beyond its current license limits because two children under age 2 were in care, but the toddler classroom and outdoor area were large enough to support the requested 8-child toddler option and the change was granted effective that day.
Observations
- Two children under age 2 were present even though the current license only allowed preschool-age children.
- Classroom #3 and the toddler outdoor play area had sufficient square footage for 8 toddlers.

101161 (a) Limitations on Capacity and Ambulatory Status. (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidence by: Based on director’s admission and LPA’s observation, the child care center operated beyond the conditions and limitations specified on the license, when two (2) children, 22 months old, were placed in the preschool program, which poses a potential risk to the Health and Safety of children in care.
