What the inspector wrote

LPA observed that the nap room is separated by a full panel door that adjoins to the infant room. There were two additional infants being supervised in the infant room with one teacher and one aide present in the infant room. Facility Representative and staff acknowledged that the door to the nap room has been observed to be closed while infants are napping. This is a repeat violation, facility was cited on 12/11/2024, for Responsibility for Providing Care and Supervision to Infants section 101429(a)(1). A $250 Civil Penalty was issued. Refer to LIC421FC. Based on LPA’s observation and interviews with the facility representative, and staff members, the preponderance of evidence standard has been met, that staff does not ensure children are provided care and supervision at all times is found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 1), is being cited on the attached LIC 9099D. LPA informed Facility Representative, Nicole Lawhorn that this report dated October 14, 2025, documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Facility Representative, Nicole Lawhorn to provide a copy of this licensing report dated October 14, 2025, that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Facility Representative, Nicole Lawhorn with form LIC 9224. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. It was alleged that staff does not ensure sinks are sanitized after use with cleaning child's feces. Facility Representative and staff denied the allegation and stated that children are placed on the diaper changing table and baby wipes are used to clean a child’s feces. Based on interviews conducted with facility representative, staff members and daycare parents, there were no disclosures that corroborated the allegations. Due to conflicting interview statements, the allegations are found to be unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
