What the inspector wrote

On 11/3/23 at 10:30am, Licensing Program Analysts (LPA) Adrian Castellon and Amber Hopkins made an unannounced complaint inspection today and met with Director Brenda Casillas to deliver complaint findings for the above listed allegations. This agency has investigated the allegations listed above. During the investigation, facility staff and day-care parents were interviewed. Facility records were reviewed. During the course of the investigation, two unannounced inspections were conducted. It was alleged that staff are not ensuring that infants sleep in cribs and Staff prop up bottles for the infants and leave them unattended . Based on staff and parent interviews and review of facility documents, it was determined that staff are not ensuring that infants sleep in cribs and staff prop up bottles for the infants and leave them unattended. Based on interviews which were conducted and review of facility documents, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Two Type A citations are cited on the attached LIC 9099D. LIC9224 process discussed. A copy of today's report, Notice of Site Visit and appeals rights given to the licensee. An exit interview was conducted with facility director and she stated that she understood. Notice of Site Visit should be posted for 30 days from today's date.

    Infants up to 12 months of age shall have a completed Individual Infant Sleeping Plan [LIC 9227 (3/20)], which is incorporated by reference. This requirementt was not met as evidenced by record reviews and staff stating that forms were not being completed and followed. This poses a risk to health and safety in care.

    101427 Infant Care Food Service (h) Infants who are unable to hold a bottle shall be held by a staff person or other adult for bottle feeding. At no time shall a bottle be propped for an infant. This requirement was not met as evidenced by staff interviews indicating that bottles were propped when feeding children. This is an immediate threat to the health and safety of children in care.

    101439.1(b) Infant Care Center Sleeping Equipment: A crib or portable-crib meeting United States Consumer Product Safety Commission safety standards shall be provided for each infant who is unable to climb out of a crib. This requirement was not met as evidenced by record review and staff interviews indicating that infants were slept in a swing and boppy pillow. This is an immediate threat to the health and safety of children in care.
