What the inspector wrote

On 9/6/2023, at 10:15am., Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced case management inspection regarding a self - reported incident. LPA met with Assistant Director, Krizia Beltran. LPA discussed the purpose of the inspection and was led on a tour of the facility. The following ratios were observed: Classroom 5 had nine children present with one staff, eight additional children from classroom 5 were on the playground with one staff, Classroom 6 had eight children present in the classroom with one staff, six additional children from classroom 6 were on the playground with one staff, Classroom 7 were observed on the playground, there were 13 children and two staff present. Assistant Director and staff stated that on 7/12/2023 from about 9:30am to 11:00am there were three teachers and 17 children on the preschool/pre-k playground. Per Assistant Director and teachers at 11:01am the teachers transitioned into the facility and Child #1 (C1) was left on the playground unattended. At approximately 11:10am, Staff #4 (S4) was walking to the toddler yard and observed C1 standing by the gate on the preschool/pre-k playground unsupervised. Per Director, C1 was on the playground for approximately 9 minutes without supervision. Interviews were conducted with the assistant director, staff, and daycare children. A review of video footage disclosed that C1 was in the garden area of the playground while the teachers were transitioning the other children from the playground to the inside of the facility. C1 was on the playground without supervision for 9 minutes. Interviews with Assistant Director and Staff #1 (S1) disclosed that the attendance log used when transitioning children was not utilized during the time of the incident. S4 stated that she observed C1 on the playground unattended, she opened the gate to the playground and brought C1 to the Director\342\200\231s office. S4 stated that C1 was observed to be crying, however no medical attention was required. Assistant Director stated that C1's authorized representative was contacted immediately. Assistant Director stated that all staff have been trained on the facility\342\200\231s supervision and roll call policy and procedure. See LIC 809C Continuation... Based on interviews and video footage, one (1) Type A deficiency of California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 809D. LPA informed Assistant Director, Krizia Beltran that this report dated 9/6/2023 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Assistant Director to provide a copy of this licensing report dated 9/6/2023 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Assistant Director, Krizia Beltran with form LIC 9224. An exit interview was conducted with Assistant Director, Krizia Beltran, a copy of this report along with the Appeals Rights (LIC 9058) was provided. A Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LPA observed Director post Notice of Site Visit on the door at the entrance.
