What the inspector wrote

On 9/29/2023, at 12:30 pm., Licensing Program Analyst (LPA) Michelle Hood conducted an unannounced case management inspection regarding a self - reported incident wherein a 2.3 year old child was found unsupervised in the facility, while the class was on the playground. LPA met with Assistant Director, Krizia Beltran. LPA discussed the purpose of the inspection and was led on a tour of the facility. The following ratios were observed: Classroom 5 had 16 children present with 4 staff, Classroom 6 had 13 napping children present in the classroom with one staff, and Classroom 7 had 14 napping children with 1 staff present. Assistant Director stated on 09/22/2023 there were 12 pre-school children with three staff from classroom #5 on the playground. LPA and Assistant Director reviewed the video footage from 09/22/2023. A review of video footage disclosed the child on the playground area playing and running around. The teacher is observed positioned facing the playground area. The teacher is observed watching the child move closer to the playground exit door while a parent exits the playground. The teacher does a 360 spin then the child is no longer observed on the playground footage. The child was observed in classroom #5 with their authorized representative. The authorized representative then brings the child back to the playground. The authorized representative is seen talking to the teacher. The teacher was not aware of the child leaving the playground and entering the building unsupervised. The child was in the building unsupervised for approximately 1 to 2 minutes before the authorized representative noticed the child. Assistant Director stated that all staff were trained on the facility\342\200\231s supervision on 09/14/2023. Based on video footage and documentation, one (1) Type A deficiency of California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 809D. LPA informed Assistant Director, Krizia Beltran that this report dated 9/29/2023 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Assistant Director to provide a copy of this licensing report dated 09/29/2023 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Assistant Director, Krizia Beltran with form LIC 9224. This is a repeat violation because the facility was cited for the same violation on 09/06/2023, for violation of 101229 (a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections. 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Immediate civil penalty of $250 was assessed for repeated violation within 12 months. The Director was provided appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. Notice of Site Visit (LIC 9213) was provided to be posted at the facility for 30 days. LPA observed form LIC 9213 posted. An exit interview was conducted .
