Inspector’s narrative

What the inspector wrote

Upon receipt of Type A citation, the Director shall post and provide copies of the LIC 9099-D for parents/guardians of children in care and for parents/guardians of newly enrolled children for the next 12 months. Director must also keep the signed LIC 9224, acknowledging receipt of LIC 9099-D in each child's file. An exit interview conducted, and report was reviewed with the Director, Nadia Khan. Appeal of Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00. During the interviews, LPA Nguyen found conflicting information regarding the above allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED. An exit interview was conducted in which the report was reviewed and discussed with the Director, Nadia Khan. LPA Nguyen provided a copy of the report and Appeal Rights to the Director. A Notice of Site visit was posted by LPA and Licensee understands it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00.

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews conducted, it was revealed that facility staff allowed childcare children to wander from the childcare facility. This poses an immediate health, safety, or personal rights risk to children in care.
