What the inspector wrote

Licensing Program Analyst (LPA) Erwin Tjhia met with Licensee, Maria Olivia Esquivel to deliver findings of the complaint investigation regarding the above allegations. There were 5 children and a staff during the visit. It was alleged that provider left a daycare child unsupervised. Throughout the investigation, LPA conducted observations and interviewed parents, staff, and children. Interviews with licensee and Staff 1 revealed that there was an incident in which licensee waited by the front door for a parent to arrive, and Child 1 (C1) exited the facility through the front door. The child was squeezing by the licensee, and made it to the gate beyond the front area patio. LPA learned that C1 was under constant visual supervision by licensee, who brought the child back inside the facility. A former staff member (S3) reported another incident in which a child was left in the front yard without adult supervision and brought to the facility by a parent. S3 had no details on that incident, and LPA was unable to obtain corroborating information. Parents who were interviewed stated that they do not have any concern with the supervision at the facility. LPA learned from child interviews that children feel they are being watched by staff. LPA observed licensee and staff to visually supervise children, be aware of their whereabouts and responsive to their needs. Based on conflicting statements and lack of clear corroborating evidence, the above allegations could not be substantiated or dismissed. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the finding is UNSUBSTANTIATED. An exit Interview was conducted with Licensee Maria Olivia Esquivel. Appeal Rights were provided, and LPA posted a Notice of Site Visit which must remain posted for 30 days.
