What the inspector wrote

On March 30, 2023 at 9:30 AM, Licensing Program Analysts (LPAs) Gigi Reyes and Dixie Wright conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by the Division of Drinking Water (DDW), LPAs met et with Child CAre Center Director, Katherine Burnett and explained the purpose of the inspection. Director provided LPAs a tour of the facility. There were 28 day care children and 5 staff present during the inspection. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101700.3, which may include remediation. The Regional Office received an ALE for one (1) water outlet in this facility. The Center was notified by LPA Reyes of the results on March 30, 2023 via phone and email. LPA advised Director that one fixture labeled E exceeded the 5-ppb action level. The said fixture is kitchen faucet. Director stated CCC seldom cook and stopped using the the said fixture after the test. During today\342\200\231s inspection, LPAs toured the entire facility and inspected the outlets in question. LPA advised Director that the affected fixture should be taped and labeled "Kitchen Faucet Closed" Director stated that, CCC seldom used the kitchen faucet inasmuch as children bring their own lunch, Continued on LIC 809 C LPA advised tha testing report must be posted and parents/authorized representative must be informed of the ALE. LPA provided a copy of PUB 515 and discussed the need for the Center to share this with families. LPA discussed a plan of correction with the director and informed director that the Plan of Correction for lead exceedances must include notification of parents and information about what has been done (their current response, such as water fixture put out of use.CCC Plan of Actions to correct the deficiency are as follows: Testing Report has been posted in the classroom which was observed by LPAs. Parents were also notified electronically through Cura Cubby application platform. The kitchen faucet which was identified with lead exceedance was taped and not available or use. Director had provided PUB 515 to parents CCC may consider replacing the kitchen faucet and/or replacing the supply lines LPA informed Director that parents must acknowledge receipt of licensing report and Plan of Correction LPA shared the following resources quick references: Quick references: \302\267 PIN 22-06-CCP - Lead Testing in Child Care Centers \342\200\223 Frequently Asked Questions \302\267 PIN 21-21-CCP - Release of the Written Directives for Lead Testing of Water in Licensed Child Care Centers Per AB 2370 A type B deficiency is being cited today.
