What the inspector wrote

On 6/22/23, at 12:45 PM, Licensing Program Analyst (LPA) Elvin Baddley conducted an unannounced Case Management at the abovementioned Child Care Center (CCC) to address an incident received by the Department on 6/9/23. The incident involved the parent of a child in care, herein P1, informing the CCC child, herein C1, had what appeared to be a bruise on the arm. Further, C1 informed P1 a teacher at the CCC had hurt C1. The parent of C1 provided the CCC\342\200\231s Director, Roseanne Escobedo Beatty, photographs of C1\342\200\231s bruises. The CCC\342\200\231s Director proceeded to review video footage from the CCC\342\200\231s nap room. The video footage revealed employee S1, who was providing care and supervision of children in various stages of sleep, restraining and forcing C1 onto a sleeping cot. The video also showed S2 entered the nap room and attempt to aid S1 by restraining C1 and placing C1 forcefully onto a sleeping cot. LPA met with Christina Olgin-Lozano, Assistant Director of the CCC and explained the purpose of the inspection. LPA notes 34 children are care at the time of the inspection. LPA reviewed CCC provided video footage of the incident to identify S2. LPA also met with and interviewed S2. It should be noted LPA showed S2 an excerpt of the video footage to confirm the identification. LPA discuss sleep practices at the CCC and how such practices related to CCC regulations. Namely, children is care should not be forced to sleep, rather CCC should provided alternative activities for child who have not elected to sleep or lay quietly in their sleep space (i.e.cot). A Type A deficiency is cited under Title 22 Division 12 Appeal rights given. Upon receipt of this report, Licensee shall post and provide copies of this licensing report to parents /guardian of children in care at the facility and to parent/guardians of children newly enrolled at the facility during the next 12 months. Licensee to provide LIC 9224 for each child in care and have each parent sign the form that they have received a copy of the report. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility representative Christina Olgin-Lozano.

    (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature...This requirement was not met as evidenced by video footage from the CCC which shows C1 being restarinted by S1 and S2 and forcefully placed onto sleeping cot to nap by S1 and S2. This poses an immediate health, safety risk or personal rights of persons in care.
