What the inspector wrote

On March 25th,2024, Licensing Program Analyst (LPA) Kassandra Medrano conducted an unannounced, case management inspection regarding lead testing for childcare centers. LPA met with AnnaMarie Franceshi, Site Supervisor, and explained the purpose of the inspection. Present during visit included 39 children and 9 staff. LPA discussed Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires the Lead Testing of water in the Child Care Center with the facility representative during the inspection. All Child Care Centers that are licensed in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. During conversation it was stated that facility is currently providing water to children via water fountains and Brita water pitchers, each child is provided with individual plastic cups. Based on review of California water board website, facility conducted their testing on 6/2/2023 and received passing scores. During visit LPA observed that results had not been posted for public display. Today a type B deficiency is being cited due to the facility not having results by or before 1/1/2023. LPA referred facility representative to the Department website for lead: Toxicity Prevention and Water Testing Information. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility representative, Anna Marie. Health and Safety code violations were found and deficiencies are being cited on the following page(s):

    (a) (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.This requirement was not met as evidenced by: Based on record review and observations it was found that facility completed lead testing after deadline, and has not posted the results for public display. This posed a potential health and safety risk to children in care.
