What the inspector wrote

On November 6, 2025 at approximately 8:45AM Licensing Program Analyst (LPA) Katie Krenn arrived at the facility for an unannounced case management visit, regarding an unusual incident that the facility self-reported. LPA met with Associate Executive Director, Alison Haas (D1) and explained the purpose of today\342\200\231s visit. Palcare has two licenses at this location. For the infant license, there were nine staff supervising 21 infants. All staff present at the facility during today's visit have received criminal background clearance from the Department of Social Services. Currently, the days and hours of operation are Monday through Friday from 6:30AM to 11:00PM. LPA and D1 toured the facility to inspect for health and safety hazards. LPA did not observe any deficiencies. The facility had already completed their own investigation into the incident. LPA received copies of statements from staff, LPA reviewed the files of the staff and infant involved in the incident. LPA interviewed D1 and several staff members. LPA also observed the damage to the facility from an incident that happened this week, which the facility also self-reported. Based on the information provided by the facility and staff, LPA determined that the personal rights of an infant in care were violated, when a former staff member used water to keep a child awake. continued on page 2 Page 2 To improve the quality and value of the inspection process, a survey will be sent to the email address provided. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with director or facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed director or facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. One type B citation was issued during this visit. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted, appeal rights and report was reviewed with the director, Alison Haas.

Based on the facility's self report and interviews, the licensee did not comply with the section cited above when a staff used water to keep an infant awake, which violates the personal rights of the infant in care and poses a potential health or safety risk to persons in care.
