What the inspector wrote

Page 2 Continued... Type B deficiency is being issued on this day in accordance with the California Code of Regulations, Title 22, see LIC 809D. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the site manager, Kelley Wheatley. A copy of today’s report was given to Kelley Wheatley.

Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.

Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229: Responsibility for Providing Care and Supervision: (a) "The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation." Based on interview, the facility did not comply with the section cited above as three facility staff interviwed stated that there was a child left alone inside the TK classroom during outdoor play, which poses an immediate health, safety or personal rights risk to persons in care.
