What the inspector wrote

On 3/11/2025, at approximately 9:00AM, Licensing Program Analyst (LPA) Alvarado conducted an unannounced annual visit at the facility. Facility is Located on the All Souls Catholic School property ; Preschool is located in a Portable behind the School campus. LPA Alvarado met with Claudia Escobar(S1) who is the Office Manager for All Souls School. At Approximately 9:30AM acting Director Veronica Lam(D1) arrived at the facility. Present in the Facility is (S1) and two staff members supervising a total of 7 children (Preschool age). The facility is operating within staffing and ratio requirements on this day. All staff present are fingerprinted, Cleared, and associated to the facility. LPA was guided by (S1) at approximately 9:30am to inspect the facility for any health or safety hazards. The Facility is a portable that is one large classroom. A children\342\200\231s bathroom was observed with two stalls and two sinks that are functioning. Facility also has a fenced outdoor play area. No Pools, hot tubs, spas, or similar bodies of water present in the facility. At approximately 10:25 (S1) guided LPA Alvarado outdoors to inspect the Play Area. Outdoor play area is a black top and a play structure that is fenced in. LPA observed the outdoor play areas to be free of debris and other loose articles. There are age-appropriate toys and equipment present. Outdoor area has a sandbox and parts of the play structures have cushioned landing areas. Each outdoor play area is enclosed by a fence that is at least four feet high. Facility Building is equipped with one fully charged fire extinguishers. Fire alarm systems and Carbon Monoxide Detector in the facility. Facility has a Fully equipped First Aid Kit. Electrical outlets are childproof and inaccessible. Poisons, cleaning detergents, and other chemicals are stored inaccessible to children in care. Continued on Page 2... Page 2 Continued... The facility has not tested its fixtures for lead with the written directive deadline of 1/1/2023. Per (S1) All Souls Catholic School Provides hot meals by request. (D1) stated that the parents also provide meals from home. Families provide sleeping bags from home to nap on. Facility uses physical paper and logs to ensure that parents sign in and out. At approximately 3:00PM all children present finished the day and left the facility. At 3:30 LPA Alvarado reviewed 2 staff files, 4 children\342\200\231s files, and facility records. All children files were observed to be complete. All staff members present have current Pediatric First Aid/CPR training that Expires 12/2025. Staff have qualifications and immunization records available for review. Fire drills are conducted once every 6 months and properly logged, Last Emergency Drill conducted on 2/21/2025. All required postings were observed to be posted and accessible for review upon entry to the facility. Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. See LIC 809-D for deficiencies being cited today on 3/11/2025 under the California Code of Regulations, Title 22, Division 12, Chapter 1. Regarding Physical Plant & Staff Records. See LIC9102-TA for Technical Advisory in regard to Physical Plant. Appeal rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit Interview was conducted with Facility Director Veronica Lam and Office Manager Claudia Escobar.

    (a) (3) The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement is not met as evidenced by: Based on observation and interview, the facility did not comply with the section cited above as LPA at 12:20PM observed S1 remove C1 during scheduled nap time, the video footage was for an incident that occured Febuary 7, 2025 which poses a potential health, safety or personal rights risk to persons in care.
