102423 Personal Rights(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee... These rights include, but are not limited to, the following:(4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature...This requirement was not met as evidenced by: Based on observation and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPA received evidence that licensee restrained day care children, which poses an immediate health, safety or personal rights risk to persons in care.

102370(d) Criminal Record Clearance (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required by the Department orThis requirement was not met as evidenced by: Based on interviews conducted and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPA received information and determined there was an unfingerprinted adult working with children in the home, which poses an immediate health, safety or personal rights risk to persons in care.

102416.1 Personnel Records (c)All personnel records shall be kept for at least three years following termination of employment/volunteer work.This requirement was not met as evidenced by: Based on interviews conducted and record review gathered during complaint investigation, the licensee did not comply with section cited above, as LPAdetermined personnel records for former staff were not maintained and were not kept for the required three years, which poses a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above as LPAs observed assistant remove bottles of two children who were already inside the crib, and in which one child was already sleeping. This poses an immediate health, safety or personal rights risk to persons in care.
