What the inspector wrote

On November 15th, 2023 at approximately 8:55am, Licensing Program Analyst (LPA) Tapia-Mandujano arrived at the facility to conduct a Case Management Inspection. LPA was granted entrance and explained the purpose of the inspection. Purpose of the Inspection was to ensure sleeping area was reverted back to how it was licensed and to ensure no exits are locked and obstructed. Present in the facility were Director and three staff supervising 8 infant children. Facility is operating within teacher-child ratio. All adults present today are fingerprint cleared and associated to the facility. During today's inspection, LPA observed that the designated sleeping area was reverted back to the way it was approved and licensed. LPA measured the designated area to ensure it was the right size. LPA measured sleeping area to be 77.76sqft. matching what was originally measured. LPA and Director spoke about the requirement about the sleeping area regulations and Director understands how the designated sleeping are must be used. On 10/10/23, LPAs Tapia-Mandujano and Tse observed that facility had installed additional child size gates in the outdoor area, not following license limitations as well as observed main gate being closed. Deficiency will be cited having exits obstructed during operational hours (Refer to LIC 809D for more information). During today's inspection, LPA observed that child size gates that were installed were completely removed. LPA also observed that the outdoor area was conditioned to use the entirety on the outdoor play area to allow 5 infants at a time. Exits and gates are now unlocked, unobstructed, and accessible during operational hours. Based on today's inspection, deficiencies were observed, according to California Title 22, Health and Safety Code of Regulations. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the director, Bernadette "Berni" Pioroda-Cruz

    101116(a): Limitations on Capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.This requirement was not met by: Based on observation and interview, the licensee did not comply with the section cited above as LPAs had observed on 10/10/23, that additional child size gates were installed and the license certificate states "all exits and gates must remain unlocked, unobstructed, and accesible during business hours" operating outside of the license limitations which poses a potential health, safety or personal rights risk to persons in care.
