What the inspector wrote

On Feburary 27th, 2025, at approximatly 11:00 AM, Licensing Program Analyst (LPA) Gil conducted an unannounced inspection in order to deliver findings on the complaint investigation for the above allegation. LPA Gil met with licensee, Grace Sobieski to discuss complaint allegations findings. Present during LPA’s visit included licensee, licenee's spouse, 1 assistant, and 9 children (6 preschoolers, 3 infants). All adults living or working in the home have on file fingerprint clearance. Based on LPA record reviews, and interviews which were conducted. The allegation may have happened or is valid, however there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Exit interview was conducted and a copy of this report was reviewed and provided to the licensee, Grace Sobieski. No deficiencies were issued today under Title 22 Division 12 of the California Code of Regulations. NOTICE OF SITE VISIT WAS GIVEN AND SHALL REMAIN POSTED FOR 30 DAYS. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

    Based on observation, the licensee did not comply with the section cited above in keeping the home clean and orderly which poses a potential health, safety or personal rights risk to persons in care.

    Based on observation, the licensee did not comply with the section cited above in not having a working carbon monoxide in home, accessible to test, which poses a potential health, safety or personal rights risk to persons in care. Per Assitant, licensee has removed detector to replace batteries. Detector has still not been placed back on celing at the time of inspection.

    102416.2 Reporting Requirements(b)The Licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child." This requirement was not met, as evidenced by the record review. The Licensee failed to report to Community Care Licensing an unusual incident involving law enforcement being called and arriving at the home. Failure to report unusual incidences as required to the Department could present potential health and safety risks to the children.
