Page 2 Continued... Based on the information received, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, are being cited. Please refer to 9099D for more information. Notice of site visit was given and must remain posted for 30 days. Failure to maintain postings as required will result in an immediate $100 civil penalty. Exit interview conducted and report was reviewed with Director, Koressa Xuereb. Appeal rights were provided during visit. This report is public and can be reviewed.

(3)To be free from corporal or unusual punishment..."This requirement was not met as evidenced by: Based on interviews conducted, the facility did not comply with the section cited above as there is sufficient evidence that the allegation of staff yelled at daycare child has occured. This poses a potential health, safety or personal rights risk to persons in care.
