What the inspector wrote

On October 29, 2025, at approximately 9:35 am, Licensing Program Analysts (LPAs) Maria Olguin-Leon and Melissa Zaragoza, conducted an unannounced, plan of correction (POC) visit. LPAs met with assistant Marina Hernandez. Present in ADU was 2 assistants caring for 10 children (3 infants and 7 preschool age). Per assistant, Licensee (Linh Tran) was on an errand. Applicant Andy Tran was in main home. LPA met with applicant and explained the purpose of the visit. Currently applicant has no enrolled children and children in ADU are enrolled under currently Licensee, Linh Tran. Licensee arrived at facility at approximately 10:05am. LPAs conducted a health and safety inspection of ADU. On October 15, 2025, LPAs Maria Olguin-Leon and Melissa Zaragoza met with applicant to conduct a prelicensing inspection. During prelicensing inspection, applicant was in ADU providing care to 10 children, which was licensed under Linh Tran. Per licensee and applicant, children in ADU were enrolled under Linh Tran. It was determined applicant was providing unlicensed care in ADU and was cited a type \342\200\234A\342\200\235 deficiency for providing unlicensed care. A POC was developed with applicant. As of this date, LPAs Maria Olguin-Leon and Melissa Zaragoza confirmed the applicant was not present in ADU providing care. Licensee Linh Tran returned to facility at approximately 10:05 am. During today's visit, LPAs did not observe signed and completed Acknowledgement of Receipt of Licensing Reports (LIC9224), as children are enrolled under Linh Tran. LPAs reminded applicant that all newly enrolled children in the next 12 months must have a LIC9224 on file. Upon approval of new licensee, children will be required to enroll under new license number and LIC9224 will need to be completed. Deficiency cited on October 15, 2025, has been cleared as of this date. LPAs provided licensee copy of POC letter. No deficiencies were cited today. Cont. page 2... Page 2... Applicant was also reminded of the following : \302\267 Applicant understands if a complaint is received in Regional Office that applicant does not live in ADU, complaint will be substantiated. \302\267 Applicant is the main provider for the licensed ADU. \302\267 Applicants\342\200\231 substitute cannot be another licensed provider. \302\267 Applicant cannot engage in outside employment that may directly or indirectly infringe applicants\342\200\231 ability to be the primary caregiver in their family childcare home (ADU) \302\267 Applicant is the only individual responsible and liable for everything that occurs in the ADU. Applicant and Licensee must remain in respective home during daycare hours. \302\267 Applicant understands children enrolled in ADU shall not commingle with children enrolled in main home, as they are two separate licenses. \302\267 Applicant understands all enrolled children\342\200\231s files must be kept in the ADU and not kept in the main home. Applicant understands all adults living or working in the ADU must be fingerprint cleared and associated to ADU \302\267 Applicant must live in the ADU. \302\267 Applicant must be present 80% of operating hours per day. \302\267 Applicant must be aware of the department\342\200\231s regulations. Prior to recommended relocation licensure, the following must be completed: -pending management review and approval. Exit interview conducted and report was reviewed with applicant, Andy Tran.
