What the inspector wrote

On 2/16/2023, and 4/28/2023 , LPA interviewed Staff # 1 and Staff # 2 Staff # 3 regarding the allegation Staff 1 pushed C1 while riding a tricycle. Staff 1 denied the allegation and stated that she was actually assisting C1 to get back to their chair. S1 explained that she placed her hand at the back of C1 and was guiding C1 to the chair. However, C1 twirled prior to sitting in the chair, and unfortunately C1 did not make it to the chair scraping their shin. Staff # 2 (S2) witnessed the incident of C1 falling on the ground and corroborated S1's statement. S2 stated S1 was not pushing C1 and was actually trying to help. S2 further added that the fall was due to C1's twirling which caused them lose their balance and fall. Staff # 3 who was in the the bicycle, scooter and tricycle pathway stated that she did not observe S1 pushing any child while riding a tricycle. S#3 added S#3 cannot recall C1 riding the tricycle. LPA Reyes also interviewed parents of currently and previously enrolled day care children and none of the parents corroborated with the allegation. Based on the investigation, the complaint allegation against Staff # 1 for pushing Child # 1 is unsubstantiated. Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the above allegation is Unsubstantiated. Notice of Site Visit was issued. FAILURE TO POST THE NOTICE OF SITE VISIT FOR 30 DAYS MAY RESULT IN A $100.00 CIVIL PENALTY Report was reviewed and exit interview was conducted with Gabrilela Landeros.
