What the inspector wrote

-Co-licensee Maria Lourdes Gastelum stated she observed co-licensee Jamie Madrid Gastelum take the child's temperature and speak with the parent. Maria Lourdes Gastelum did not corroborate complainant's statement. -LPA contacted the local sheriff's department which revealed a service call was conducted to the family child care home. There was not written report to document the incident. The allegations are unsubstantiated, based on LPA's interviews with Licensee Madrid Gastelum and Maria Lourdes Gastelum and parents of children in care. Although these allegations may have occurred, there is not a preponderance of evidence to prove that the alleged violations did or did not occur, therefore, the allegations listed above are deemed UNSUBSTANTIATED. Exit interview was conducted with the Licensee Maria Lourdes Gastelum, during which time appeal rights were explained. This report and appeal rights and Notice of Site Visit (LIC9213) were provided.

    To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, .... This requirement was not met and evidenced by:LPA's observation of staff #1 inappropriately handle child #1 by the right upper arm and push the child down on the cot. This poses an immediate risk to the Health and Safety of children in care.
