What the inspector wrote

On February 21, 2025 at 1:40 PM Licensing Program Analysts (LPAs) Elizabeth George and Rosie Breault conducted an unannounced case management - licensee initiated inspection. LPAs met with Director Jim Murphy and discussed the purpose of the inspection. LPAs in the company of the Director toured the inside and outside of the facility. There were 3 children present at the time of inspection. Licensee submitted an application to license the front entry area for children to play. LPAs noted area to be surrounded with a 4 foot fence. LPAs noted that areas behind large bush and corner pot to meet regulation height. LPAs took measurements which resulted in 1076.27 square feet which will allow for licensed capacity. During the course of the case management inspection LPAs observed the following: While returning from outside LPAs were unable to locate licensee and three children within the licensed preschool. LPAs followed the sounds of voices heard from within the church and located the licen see and children in the men's restroom located in an unlicensed area. LPAs inquired, licensee stated facility bathroom and staff bathroom were not functioning. LPAs observed bathroom to have a smell, and remnants of back up on the floor near drain. LPAs inquired about not reporting, licensee stated he was unaware he had to. LPAs received LIC624 during exit interview. LPAs advised if no bathrooms are available to children within licensed facility licensee must alert Community Care Licensing Division (CCLD). This is a violation of Title 22, Division 12 101238(a), and a Type B violation is being cited. Based on non-functioning toilet, licensee was out of compliance by allowing children use of bathroom in an unlicensed area. Upon entering facility LPAs observed 3 children napping in the cubby hallway. LPAs advised licensee that during pre licensing children must nap in the classroom. In addition, LPAs observed half door leading to private elementary school which was installed per regulation, as a condition of licensure, to be open and elementary child in licensed child care center. LPAs inquired, licensee stated door open for ventilation. LPAs advised elementary schools own private door leading to outdoor space was currently open. LPAs also observed, and licensee confirmed, elementary school children storage drawers used daily are located within licensed child care facility. This is a violation of Title 22 Division 12 101161(a), and a Type B violation is being cited. Continued on 809-C While touring back outdoor play area LPAs observed electrical room door to be unlocked. Per pre licensing inspection LPAs advised licensee electrical door must remain locked during hours of operation. In addition, during inside tour, LPAs observed an accessible lower cabinet located in the cubby hallway next to child's mat. Cabinet contained finishing nails which were next to additional mats and blankets for children. Licensee was advised at pre licensing inspection all sharps and tools must be rendered inaccessible to children when not in active supervised use. This is a violation of Title 22, Division 12 101238(g), and a Type B violation is being cited. Three Type B deficiencies have been cited during todays visit on attached LIC809D. Exit interview conducted, report was provided to licensee, Jim Murphy, with appeal rights. Notice of Site Visit was provided and must remain posted in a prominent location for 30 days.
