What the inspector wrote

Licensing Program Analyst (LPA) Liridon Fici- Doni arrived unannounced to conduct a Case Management Inspection. The department received an incident report, dated for 3/28/2025 . LPA met and was greeted by PERLINA CHAVEZ- Director and informed her the purpose of today's inspection. During visit, LPA interviewed Director, Chavez, Perlina regarding an incident that occurred on 3/21/2025 . Director informed LPA on 3/21/2025, she was in her office, located in the preschool classroom and heard a child. Director looked at the camera and did not see anything. Director than heard the child again and ran outside of the preschool class/office to see what it was. Director saw C1, standing outside of the toddlers preschool class and approached the child and picked him up. Staff 2 (S2) also ran out of her class, meeting the director outside of the toddlers classroom. The director, S2, and C1 entered the toddlers classroom and asked Staff 3 (S3), “what happened”. S3 stated that she counted all the children, but possibly counted the same child twice. The director than proceeded and informed staff that, children need to be counted for before conducting transitions to ensure children are present. The director informed LPA that the incident occurred during lunch time transition from outside play to inside. Page 1 of 2 The following type A deficiency was cited on the attached page (809-D). Licensee was informed that failure to correct the deficiency by the specified Plan of Correction (POC) Due Date may result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made. Due to the issuance of a Type A Citation during today's inspection, a copy of this Licensing Report must be given to each existing parent by the end of today or next day child is in care, and to the parent of children enrolled over the next 12 months. In addition, a copy of the LIC 9224 Acknowledgement of Receipt of Licensing Reports must be signed by each parent and kept in each child's file . A notice of site visit was given and must remain posted for 30 days. Exit interview conducted with Licensee, and a copy of this report was reviewed and provided along with appeal rights.

(1) No child(ren) shall be left without the supervision of a teacher at any time...This requirement is not met as evidenced by: Based on interview, the Director did not comply with the section cited above by having C1 unsupervised in the toddlers playground during transition from playtime to lunch which posed a Immediate health, safety, or personal rights risk to persons in care.
