What the inspector wrote

Licensing Program Analyst (LPA) Pete Hernandez and Licensing Program Manager (LPM) Gladys Kuizon met with Anne Horgan, Director, for an unannounced Case Management visit. LPA explained that the purpose of the visit is to deliver findings. From 09/19/2022 to 10/25/2022, the Department conducted an investigation into the incident. The investigation included interviews of teachers and parents, and a facility inspection. The incident involved alleged inappropriate touching between two children in care, C1 and C2. Child 2, C2, disclosed to C2's parents that child C1 took C2's pants off and touched C2's private parts. C2 also stated [Teacher 1, T1] (Assistant T1 witnessed the incident; however, T1 stated she never witnessed any incident in that nature. Additional teachers were interviewed who also denied witnessing any incidents in the way C2 described. West Valley College Child Development Center (WVCCDC) is an outdoor classroom. Teachers are placed in sections across the outdoor field to watch each "play zone" and keep children supervised. The sandbox, where C2 said this incident took place, is an open area. The teachers are with the children while they play in the sand box. During the investigation, the physical plant was inspected. Based on information obtained, a possible lack of supervision resulting in the inappropriate touching between C1 and C2 is unsubstantiated. There is not a preponderance of evidence to prove that a violation did or did not occur. No deficiencies were cited. An exit interview was conducted with the Director. A copy of this report was discussed and left with the Licensee, Anne Horgan, whose signature on this form confirm receipt of these documents. A NOTICE OF SITE VISIT WAS ISSUED, POSTED NEAR THE ENTRANCE TO THE FACILITY, AND MUST REMAIN POSTED FOR 30 DAYS.
