What the inspector wrote

On Tuesday, April 19, 2022 at 9:35 am, Licensing Program Analyst (LPA) Manel Estoesta conducted an Unannounced Required One (1) Year Visit. LPA met with the Director Tania Trejo and explained the nature of the site visit. Present on this visit were 22 infant children and 7 staff members. Facility operates from Monday to Friday LPA toured the facility to conduct a health and safety inspection with the Director. The facility has a preschool and school age component on site. Infant Room and the Toddler Room were physically separated from the areas used by the preschool age childcare program. There were no bodies of water observed. Director stated that facility does not possess nor store any weapons on the premises. Disinfectants, cleaning solutions, sharps, and other items that are dangerous to infants were stored inaccessible. LPA did not observe flies, other insects, and rodents during today's inspection. Furniture and equipment such as cribs, mats, feeding chairs, and changing tables were in sanitary and safe condition, free of sharp, loose, or pointed parts. Infant changing tables were located within arm\342\200\231s reach of a sink. There were no baby walkers observed on the premise during today\342\200\231s inspection. Outdoor activity space is fenced and play equipment were maintained in a safe condition and free of hazards. Areas around and under high climbing equipment and slides were cushioned with material that absorbs falls. There were shaded rest areas for children. Drinking water is arranged to be readily available for children in care. LPA observed that bottles and containers of food brought into the facility by the infant's authorized representative were individually labeled with the infant's name and current date. LPA observed a fire extinguisher, First Aid Kit, and smoke and carbon monoxide detectors. Milpitas Fire Department Permit expires on 12/31/2022. Fire and Disaster drill was last conducted in March 2022. SEE 809 C.... Continuation... Infant sign in and out procedures and logs, and Sleep Logs were reviewed. A sampling of Infant files was selected for review. Records reviewed includes Admission Agreement, Identification and Emergency Information, Needs and Services Plan, Individual Feeding Plan and LIC 9227 (infants under 12 months). A sampling of Staff files was selected for review. Records reviewed include Criminal Record and Child Abuse Index Clearance, Health Screening Report with TB Clearance, Immunization Record for Measles and Pertussis, and required Training such as the AB1207 Mandated Reporter Training. LPA reminded the Director that only the Influenza vaccination can be decline with a written declination. All of the Staff has a current CPR and First Aid Training Certificate that will expire on 03/26/2024. Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. SEE 809 C.... Continuation...... LPA discussed the Guardian User Information, PIN 21-21-CCP and PIN 22-10-CCP. LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. For licensing updates, please email childcareadvocatesprogram@dss.ca.gov and request to be added to the email list. Previous Provider Information Notices (PINs) - Child Care Licensing Program (CCLP) are available at the CCLD website and other helpful information at https://cdss.ca.gov/inforesources/child-care-licensing . A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
