What the inspector wrote

Licensing Program Analyst (LPA) Marilou Monico conducted a Case Management inspection in response to an incident that was reported by the facility to Licensing on August 5, 2024. LPA met with Site Director, Tim Harper, and explained to him the purpose of today's inspection. LPA toured the facility, interviewed staff, reviewed a file, and obtained copies of documents. Based on interviews and available evidence, a teacher (S-1) was witnessed speaking harshly to a preschool child, pushing the same child and withholding food to the child on the morning of August 5, 2024. Site Director was informed of the incident and the teacher was placed on administrative leave effective that same day. The teacher is still on administrative leave. As a result of this inspection, Type A deficiency was cited on the following page. Assembly Bill (AB) 633 was provided and discussed with Site Director. LPA informed the Site Director to provide a copy of this licensing report dated 08/08/24 that documents a Type A citation to parents/guardians of all children currently enrolled no later than the next business day or the next day the children are in care, and to parents/guardians of any newly enrolled children for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224) must be placed in the child's file for verification. Exit interview conducted and report was reviewed with Site Director, Tim Harper. A Notice of Site Visit was issued and must remain posted for 30 days.

    Personal Rights - The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: A teacher (S-1) was witnessed speaking harshly to a preschool child, pushing the same child and withholding food to the child on the morning of 08/05/24. This poses an immediate risk to the health, safety, and personal rights of children in care.
