What the inspector wrote

Licensing Program Analyst (LPA) Marilou Monico met with Site Director, Tim Harper, for an unannounced Case Management inspection. LPA toured the facility and a census was taken. The purpose of today's inspection was to address an unusual incident reported to the San Jose Regional office on October 17, 2025 and an Unusual Incident/Injury Report (LIC 624) was submitted on October 22, 2025. The incident occurred at the facility on October 15, 2025 involving a day-care child (C1) who was found alone by Staff (S1). Today, LPA interviewed staff. S1 stated that while walking back from the bathroom, she saw C1 alone walking in between Room 35 and Staff Lounge building, outside the gate of Stage Yard playground. S1 returned the child to Room 26. C1 was initially in the Stage Yard. Staff who were in the yard were unaware that C1 exited the gate. C1's parents were notified of the incident. There were 4 staff in the yard with approximately 25 children when the incident happened. Per California Code of Regulations Title 22, Chapter 1, the following deficiency is cited: (see LIC 809D) Assembly Bill (AB) 633 was provided and discussed with Site Director. LPA informed the Site Director to provide a copy of this licensing report dated October 23, 2025 that documents a Type A citation to parents/guardians of all children currently enrolled no later than the next business day or the next day the children are in care, and to parents/guardians of any newly enrolled children for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224) must be placed in the child's file for verification. Exit interview conducted and report was reviewed with Site Director, Tim Harper. A Notice of Site Visit was issued and must remain posted for 30 days.

This requirement was not met as evidenced by: On 10/15/25, Staff (S1) found a child (C1) alone in an area between Room 35 and staff lounge building. This poses an immediate risk to the health, safety, and personal rights to persons in care.
