What the inspector wrote

Licensing Program Analyst (LPA) Marilou Monico conducted an unannounced Case Management inspection regarding an unusual incident that was self reported by the facility to the San Jose Regional Office on February 21, 2026. LPA met with Site Director, Tim Harper. LPA toured the facility and census was taken. LPA interviewed staff. LPA obtained pertinent documents. On February 20, 2026, as staff (S1), parent (P1), and daycare child (C1) were leaving the building from Room 16, they observed daycare child (C2) alone outside the front door of Room 15. Based on interviews, there was a family social gathering in Room 16 from 9 AM to 10 AM attended by staff, children, and parents of children enrolled in Room 15 and 16. After 10 AM, the children in Room 15 returned to their classroom and staff didn't realize that C2 was left behind. Site Director notified the parents of C2 of the incident on February 20, 2026. Per California Code of Regulations Title 22, Chapter 1, the following deficiency is cited: (see LIC 809D) Assembly Bill (AB) 633 was provided and discussed with Site Director. LPA informed the Site Director to provide a copy of this licensing report dated February 26, 2026 that documents a Type A citation to parents/guardians of all children currently enrolled no later than the next business day or the next day the children are in care, and to parents/guardians of any newly enrolled children for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224) must be placed in the child's file for verification. Exit interview conducted and report was reviewed with Site Director, Tim Harper. Copy of appeal rights was provided to Tim. A Notice of Site Visit was issued and must remain posted for 30 days.

This requirement was not met as evidenced by: On February 20, 2026, a child (C2) was unattended outside the front door of Room 15. This poses an immediate risk to the health, safety, and personal rights to persons in care.
