What the inspector wrote

Licensing Program Analyst (LPAs) Samantha Yip and Mandeep Kaur conducted an unannounced Required- 3 Year inspection. LPA met with Director Judy Camarena Soto and explained the reason for the inspection. Present during today's inspection were 12 children and at least two staff. Facility was within ratio during today's inspection. There is a board to post required posting, such as license, notification of parents rights, and car seat. The hours of operation are Monday through Friday 8AM to 2:45PM. LPA toured the inside and outside of the center. Disinfectant and cleaning supplies were inaccessible to children. LPA discussed with Director that anything sharp, such as grater, peelers, or knives need to be inaccessible to children. LPAs observed that the thermostat read 65 degrees Fahrenheit. LPA discussed with Director that the minimum temperature inside is 68 degrees Fahrenheit. Director raised the temperature during today's inspection. There are toys and equipment for children. There is fully charged fire extinguisher, smoke detector, and carbon monoxide detector. The last fire/disaster drill 01/12/2024. Director stated that there are no weapons, such as firearms, on the premise. The facility is only using the outside area that is adjacent to the room and is fenced. Area around play structure has resilient material. Shaded rest area is provided through canopy. There were no bodies of water observed. Facility no longer uses the playground that is shared with the elementary school on campus. Measurements for the outside area was completed during today's inspection. The measurements are as followed: (90.333 x 45.417 = 4,102.653) + (20.583 x 8.750 = 180.101) = 4,282.754 minus encumbered space 945.359 = 3,337.395 Total Outdoor Space: 3,337.395 divided by 75= 44 children ----------------CONTINUES ON 809 DATED 01/25/2024 PAGE 2------------------ -----------------continuation of 809 dated 01/25/2024 page 1-------------------- LPA reminded Director about notifying Licensing of any changes, such as adding a space. Director will submit updated LIC 999: Facility Sketch for the outside. Director was advised that an updated fire clearance is needed. All meals and snacks are prepared and brought from home. Drinking water is provided through individual water bottles and water fountain. There is water bottle refill station outside, which director stated that they do use and was not tested for lead. Director stated that she will cap off the water bottle refill station outside and send proof to Licensing. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. LPA verified that the lead testing was completed for the water fountain located inside the room in accordance to the Written Directives outlined in PIN 21-21.1-CCP . Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Seven (7) children files were reviewed. The records reviewed were immunization records and admission agreement. Three (3) staff files were reviewed during today's inspection. The record reviewed include but not limited to Mandated Reporter training and immunization records. All staff have a valid CPR/1st Aid, which expires on 08/2025. At 11:19AM, LPA observed that a child went to the restroom. Staff were at the desk area. Staff cannot see child in the restroom from where they were standing. LPA discussed with Director that children need to be visually supervised at all time. All staff present have cleared criminal record and child abuse index. Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Center will submit the following: - Preventive Health and Safety training for Director by 02/25/2024 - proof that water bottle refill station is capped off by 02/25/2024 - LIC 999: Facility Sketch for Outside by 02/02/2024 - S-1's immunization record for measles, pertussis, flu and Mandated Reporter training by 02/02/2024 As a result of this inspection, Type B citations were issued. Exit interview conducted and report was reviewed with Director Judy Camarena Soto. A notice of site visit has been issued and must be posted for 30 days.
