What the inspector wrote

Based on the information gathered during the investigation, it was corroborated that the staff #1\342\200\231s conduct toward day-care children was inappropriate. The staff member used a harsh tone and handled the children roughly, which constitutes a violation of the children\342\200\231s personal rights and does not meet the standards of care required in childcare facilities. The preponderance of evidence standard has been met; therefore, the above allegation is SUBSTANTIATED. Due to this investigation, a Type B Deficiency has been cited on the attached LIC9099-D page. Exit interview conducted with the Facility Representative. Report was reviewed and provided to Facility Representative Michelle Lee along with appeal Rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

    101223(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on observations, record review and interviews conducted, it was revealed that Staff #1 (S1) mishandled children in care. This poses a potential risk to the health, safety and personal rights of children in care.
